Example — Property Division A State’s law generally says that any assets acquired during a marriage are divided equally. Divorce Litigation: A Judge would likely order the home to be sold and profits divided 50/50. The retirement account would also be divided 50/50. Divorce Mediation: You have the flexibility to get what you want. One person can keep the house, while the other keeps the retirement account, and you can find another way to ensure the overall outcome is fair. Your mediator will guide you through these issues and help you find solutions that meet both of your needs.

Divorce Litigation: A Judge would order a strict parenting time schedule, without your consent, that dictates when you will see your kids. Divorce Mediation: Understanding your work schedules and your kid's school and activity schedules, your mediator will provide several parenting schedule options that may work perfectly. You can even customize what a “weekend” means to you:

  • Friday after school to Monday morning
  • Friday after school to Sunday evening
  • Saturday morning to Sunday evening or Monday morning.
